The Legislative Duma of the Khabarovsk Territory adopted the Law of the Khabarovsk Territory "On the authorized representative of the indigenous peoples of the North in the Khabarovsk Territory." In paragraph 5 of Art. Section 5 of the Regional Law establishes the procedure for the participation of citizens in the meeting for the election of authorized representatives of the indigenous peoples of the North. In particular, the age limit for participation in such a meeting is established - reaching the age of 18 on the day of the meeting.
The prosecutor of the Khabarovsk Territory filed a lawsuit declaring the Khabarovsk Territory Law to be in violation of federal law regarding the establishment of age qualifications, referring to the fact that it contradicts paragraph “c” of Article 71 of the Constitution of the Russian Federation, paragraph 7, part 1, paragraph 2, part 2 of article 8 Federal Law “On Guarantees of the Rights of Indigenous Minorities of the North, Siberia and the Far East of the Russian Federation”.
