The court refused Tishchenko's lawsuit on the grounds that the parties are not married, the plaintiff never worked, the house was purchased entirely at the expense of Zhigalin. “However, there is no reason to consider,” the decision stated, “Tishchenko has no right to use the living space in it.”
The court recognized Tishchenko's right to use one of the three rooms in the house.
